I really advise you guys to settle this before it goes to court.
If he files a police report and sues: you will be prosecuted criminally by the state for grand larceny and/or fraud, then you can be sued and tried in civil court for defrauding a person of money or property. He can then be compensated for all court fees, attorney fees, as well as his personal loss from never receiving a transmission to make his vehicle function (compensatory damages). If one is convicted criminally they could face more fines and penalties of supervision, probation, and/or even jail time.
You guys really need to stop playing the "blame game" of who is at fault. Matt may no longer be a parter/employee/affiliate of the shop but at the time of the sale it was listed online by the shop and the payment was taken through the shop's paypal. Therefore, the shop is liable and responsible to find a solution or give a refund immediately; regardless of who was actually responsible for the sale or whose pocket the money went in. That's business.
On a side note, you cannot blame a former parter of a business for any mistakes. In a partnership ALL entities/partners are equally liable and responsible for the business. Rob said, "Matt was never a partner of this business" which may be true... Matt may not have technically or legally been a partner of FBI "on paper," but, he certainly was involved with the shop by managing some of the internet sales for used parts; which means he was working for them; and that makes him an employee of the shop. Which in turn, could put Matt at less of a liability (if any for that matter) for the fraudulent sale made to Ed since Matt is no longer an "employee," the problem is still the shop's responsibility to fix.
With all that said, I am really disappointed to see this has not been resolved. Consequently, I have removed Fully Built Inc. from our vendors/sponsors on the site. Grab-A-Lane will NOT promote or be affiliated with any shops that conduct bad business with our members. I'm sorry guys but you dug your own grave on this one... You have had more than enough time to straighten this problem out. A speedy resolution to this problem would have been a great testimony of better business ethics and changed ways in comparison to your past's reputation of bad business deals that have recently been shared all over other websites.
I want to wish all parties involved the best of luck on getting this properly resolved before it gets messy and goes to court.
